Terms and Conditions for the supply of coaching services

INTRODUCTION

  1. HelpMePresent agrees to provide and the client/customer agrees to undertake and pay for the training sessions supplied under this agreement. The terms and conditions of this agreement apply to services provided by HelpMePresent via online coaching or in any other capacity. 

 COACHING SERVICES

  1. All our coaching sessions take place online via Zoom. Booking and registration for our services takes place online. 

  2. Online coaching sessions works under the assumption that the client/customer has good wifi connection and has Zoom installed onto their device. We expect the client/customer to check and ensure their systems are working before a coaching session takes place.  

  3. The description, length of time for the session and charges for the course are set out in advance and are expected to be respected and adhered to by both parties.

  4. The length of each session is usually 1 hour long. HelpMePresent will end coaching sessions after this time period. Any accidental time over this due to the coaches goodwill, will not be charged to the client/customer. 

  5. The number of coaching sessions will be agreed at the start of coaching between HelpMePresent and the client/customer via email or written correspondence. Where no specific number is agreed, sessions will be provided on a session by session basis. Full payment is due 24 hours before any session unless otherwise agreed and specified with the client. Additional sessions can be booked thereafter.

  6. HelpMePresent may assign the client/customer tasks or exercises to complete between coaching sessions. Not completing these tasks may slow the client/customer's progress in improving their goals and personal outcomes. 

  7. HelpMePresent will not be liable for any technology failures that take place in coaching, from either the coach or client/customer. HelpMePresent runs its coaching using third party vendor Zoom, via the Wix platform, and customers must ensure they have this software capability before purchasing a session. They should also ensure they are connected to good wifi and connection and are responsbile for doing this before any session takes place. Any technical issues on the side of HelpMePresent will aim to be resolved immediately. In the event that coaching cannot take place due to poor connection or other technical issues by either party, HelpMePresent will refund the customer for their session in full. 

  8. HelpMePresent aims to meet or exceed the customers expectations by offering excellent coaching services. Any complaint or comment to improve our service should be directed in writing via the contact submission form as soon as possible to allow timely resolution. 

  9. We will treat all information received from you (except information published generally by you) as strictly confidential and will only use or disclose it as may be required in the performance of services.

PAYMENT, CANCELLATIONS AND REFUNDS

  1. Payment must be made at least 24 hours prior to any coaching session. HelpMePresent reserves the right to reschedule or cancel if monies are not received before coaching takes place.  

  2. Payment is taken online through our booking procedure.

  3. Once you have booked a session, your place is nonrefundable. You may change the date of your participation, provided you give no less than one week prior notice. 

  4. If the client needs to rearrange a coaching session, they should provide at least 48 hours’ notice to the session. No refunds will be given to clients for unused coaching sessions unless 48 hours’ notice has been given. In exceptional circumstances HelpMePresent may need to rearrange a coaching session. In these circumstances, HelpMePresent will use reasonable endeavours to provide a mutually satisfactory alternative appointment with the client.

  5. In exceptional circumstances, such as illness or unavailability due to bereavement or other commitments, inappropriate behaviour by the client, actual or potential conflict of interest, or other reasons, HelpMePresent can decide to terminate the service to the client early or refuse or be unable to provide further coaching sessions to the client. In such a circumstance the client will be given reasonable notice of termination  and will be refunded for any advance payments made for coaching sessions not yet provided.

  6. If the session does not run on the date/time advertised for any reason, we will offer an alternative session (from the list of available dates). If the session must be cancelled by HelpMePresent for any reason unforeseen, a full refund will be made. 

  7. HelpMePresent reserves the right to cancel or reschedule any session due to unforseen circumstances. We will not be liable for failure to provide services where it is not reasonably practicable to do so due to circumstances beyond our control (force majeure).

  8. In the event that HelpMePresent is obliged to cancel or reschedule any course we will refund all monies paid by the client/customer.  HelpMePresent accepts no liability for travel, accommodation or incidental costs incurred by the client/customer in the event that any course is cancelled or rescheduled.

LIMITED LIABILITY 

  1. We shall have no liability for any indirect or consequential losses or expenses suffered by you, however caused, including, but not limited to, loss of anticipated profits, goodwill, reputation, business receipts or contracts, or losses or expenses resulting from third party claims.

  2. Nothing in these Terms shall be interpreted as excluding or restricting any legal liability for death or personal injury resulting from our negligence or the negligence of our employees, agents or sub-contractors.

COPYRIGHT

  1. The copyright and all other intellectual property rights in all courses shall remain the sole and exclusive property of HelpMePresent. Sessions must not be recorded and distributed to any parties other than the client/customer.  The client/customer agrees they will not copy (including record) or permit the copying of coaching materials, nor disclose or permit disclosure or sell or hire the same to third parties, nor use the same for running the customer’s own courses unless the express written permission of HelpMePresent is given.

  2. No content from this website in language may be used or reproduced in any manner whatsover by any other party without the express written consent of HelpMePresent and its parties. 

APPLICABLE LAW 

  1. The supply of services by HelpMePresent shall be governed by the laws of England and exclusively justiciable in the English courts.
